Signature Membership Agreement

This Membership Agreement (the Agreement) is effective January 01, 2023 between the Longevity Care Clinic, hereinafter referred to as Longevity, accessed via www.longevitycareclinic.com with a business address of 1624 S 21st Street, Colorado Springs, Colorado 80904, and you, hereinafter referred to as “Member”.

By accessing, browsing or using the https://www.longevitycareclinic.com website or by selecting “I Accept” during the membership registration, you represent that you have read, understand and agree to be bound by the terms and conditions of this Membership Agreement hereinafter referred to as Agreement.

1. Nature of the Service

The Longevity Signature Membership is access to select services listed below provided by Longevity Care Clinic. The Signature membership provides to its members benefits listed below:

• Ionic Foot Soak monthly
• Infra Red/PEMF monthly
• E Stim Pelvic monthly
• Vitamin B Injection weekly
• Body Scan quarterly
• Access to Members only site.

2. Banking/Roll Over Services

All monthly services are included in the Signature Membership rollover. Any service not used in a month rolls over and is available to be used in the following month. Services must be scheduled in advance and can not be exchanged for other services.

3. Cash Pay for Members

All services offered at Longevity Care Clinic are cash-paid. Longevity offers a 25% discount to all Signature Members for Cash Pay provider appointments. Those include Functional Medicine Initial and Follow up visits, acupuncture, nutrition, chiropractic, PRP, and health coaching.

4. User Registration and Information

Member shall fill in the correct information requested in the User Registration form on the site. Member shall be required to promptly update the User Information on the site. Member shall select a username and password during the User Registration process. Member shall be responsible for: a) all use of the Site made by the Members username and password, and b) maintaining the confidentiality of the Members username and password.

5. Members only Content

The Content includes education on therapies included in the membership, links to member only videos, updates by Dr. Pavlovic, Shawnee Starr, and other guest lecturers on health topics. Member only discounts and specials will also be posted on this site along with ease of scheduling. Member acknowledges that all content is the exclusive property of Longevity Care Clinic and is intended to help members improve their knowledge bases so they can make informed choices when it comes to Lifestyle and ways to improve health. Members do not have authorization to copy or sell any of the Content.

6. Release

If a member wants to share information from the site, they need to obtain written authorization from Longevity Care Clinic.

7. Privacy

Longevity Care Clinic shall not sell or rent Members personal information to third parties. All member’s information is stored in HIPPA compliant systems that are protected by technological security devices.

8. Indemnity

Member shall indemnify and hold the Longevity Care Clinic (and its officers, directors, agents, subsidiaries, joint ventures and employees) harmless from any claim or demand, including reasonable attorneys’ fees, made by a third party due to or arising out of Members breach of this Agreement, or Members violation of any law or the rights of a third party, members improper use of equipment, side effects, or injury that may arise from any equipment or therapy undergone at the clinic.

9. No Agency

No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

10. Pricing

The 2023 Pricing for Signature Membership is $139 per month. Membership pricing is locked in for one year, twelve months.

11. Auto Renewal Annual Membership

Memberships are billed monthly on the same date of the month in which it was started automatically to credit card/debit card. The number of therapies automatically populate in members account to be added to a remaining balance. Members will auto renew on month 13.

12. Non-Auto Renewal

Members can select to not-auto renew the annual membership at any time. If member chooses to non-renew, all therapies or services that have accumulated over the year immediately expire on the last day of the membership. Roll over amounts have no cash value and can not be refunded. Member shall choose to non renew a membership for NO FEE after the initial twelve(12) month commitment.

13. Early Termination of Membership

Member shall choose to terminate their membership early for a $199 termination fee. Upon date of termination, all therapies or services that have accumulated over the months immediately expire. Roll over amounts have no cash value and will not be refunded.

14. Governing Law

This Agreement shall be construed under and governed in accordance with the laws of the Colorado.

15. Arbitration

Any dispute arising under this contract shall be resolved under the commercial arbitration rules of the American Arbitration Association.

16. Limitation of Liability

Member shall not hold Community responsible for other user Members content, actions or inactions.
